A K-1 visa is a visa granted to the fiancé or fiancée of a U.S. citizen to immigrate to the United States. A K-1 visa requires that you marry in the first 90 days of arriving to the United States to be able to adjust status. • In order to petition for your fiancée, you must file Form I-129F, Petition for Alien Fiance(e) with USCIS.

• Once USCIS has received your application, they will send you a notice for a biometrics appointment where they will take your photo and fingerprints.
• If USCIS determines that it additional information is needed, you may receive a Request for Evidence.
• After the interview, if approved, your fiance will receive a K-1 stamp in their passport so that they can travel to the U.S. You must then get married within 90 days of your fiance’s arrival to make sure you sty in compliance.
• After you are married, your spouse can then apply for their permanent residency while remaining in the U.S until the process gets finalized.
• Both the U.S. citizen petitioner and immigrant (alien) beneficiary must willingly and legally get marriage in the United States.
• The petitioner and beneficiary must have previously met in person in the last two years unless the Attorney General waives that requirement.
On average, it takes about 6 months for your fiancé to receive their visa from the cosulate from the time that you submitted your application to USCIS. Keep in mind however, that processing times are always changing and may vary depending on your local office.
